Our Contract

These terms and conditions govern the supply of goods sold by the SDS Group (SDS Heritage), Jordan House, Old Milton Green, New Milton, Hampshire, BH25 6QJ, UK ("we" and "us") to the customer named on the order form provided on the web site. Together with the completed order form, these terms and conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

Price and Payments

The price payable for the goods you order is as set out on our web site at the time you place your order or, if you order by any other method, the prices will be as stated, whichever method of ordering plus any charges for postage and packing as stated. We must receive payment for the whole of the price of the goods you order before it can be accepted.

Postage and Packing

Postage and packing is calculated based on the number of items in your basket, and where in the world you want them delivered. There are three zones to choose from: UK, Europe and Rest of the World. For one item, the rates are £2, £3 and £4 for each of the zones respectively. For each additional item, 40p, 50p or 60p is added to the P&P charge, depending on the postal zone. For example, if you live in the UK, and order three items, the total P&P is £2.80. But we don't keep adding. There is a maximum charge for P&P, irrespective of the number of items in your basket. Here's a guide:

Zone Postage for one Item Per additional item Maximum charge
UK £2.00 40p £5.00
Europe £3.00 50p £8.00
RoW £4.00 60p £10.00

Items are sent first class in the UK. Overseas orders are sent via small packet.

Availability of Goods

While we endeavour to hold sufficient stock to meet all orders, there may be occasions where we do not have the items to fulfil your order. We will not take payment until all of the items in your order are ready to be dispatched, so please be patient. We will inform you if an item is out of stock and if a delay is expected.

Returns

Because of the nature of our software-based products, items may only be returned because they are faulty or incorrect. This does not affect your statutory rights.

Liability

If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
